Term Condition


All correspondence(s) have to be addressed to India Awaits regarding Tours, Travel Services, and bookings.

Booking:
After we confirm your tour/travel services and receive the deposit fee from you, we will confirm the booking and a contract will be formed between you and India Awaits.

Payment:
You have to make a minimum deposit of 50% of the total cost to India Awaits for the services contracted. The deposit is required to keep the booking confirmed.

Balance Payment:
The balance payment is to be made 15 days before the services start. Any booking made within 15 working days of the date of service will be considered as late booking, and full and final payment is required at the time of booking.

Note:
  • Other than the above, full payment is necessary at the time of booking for special train travels, hotel, or resort bookings during peak season (Christmas, New Year, Pushkar Fair, Diwali, etc.).
  • Even after paying the 50% deposit to confirm your bookings, you may need to pay an extra advance amount before the final balance payment date, based on the contractor/supplier's payment deadline, as applicable.

Note:
  • All payments should be exempt from withholding tax and deduction.
  • Any bank charges(if any) for remittance (by remitting bank or intermediary bank) would be payable solely by the payer.
Special Note:
Please note that the agents and employees at India Awaits will not call or text you regarding your Net banking details such as Login, Password, OTP, etc. Also, we only want you to transfer funds to our official bank account rather than the personal account of the agent or employee. Do not transfer funds to third-party apps such as Any Desk, TeamViewer, etc.

Cancellation Policy / No Show / Early Departure:
In case of cancellation of the travel services due to any avoidable/unavoidable circumstance(s), you need to inform us in writing or a mail. Cancellation charges will be effective from the date we receive the letter or your mail. The cancellation charges would be as follows:
  • 60 days & before arrival - 15% of the tour/service cost.
  • 59 days to 30 days before arrival - 30% of the tour/service cost.
  • 29 days to 15 days before arrival - 50% of the tour/service cost.
  • 14 days & less, before arrival or no show - NO REFUND.

Note:-

  1. Irrespective of the cancellation slabs we have mentioned above, if you (client) cancel the tour/travel services (due to whatever reason) after the booking is made with us – a minimum 10% service charge would be applicable on the total cost of the tour package.
  2. Irrespective of the cancellation slabs we have mentioned above, if we (India Awaits) cancel the tour/travel services (due to whatever reason) after the booking is made – The following two options are available: - We (India Awaits) provide you (the client) with a credit note for the booking amount paid. You (client) can use the credit note anytime in the future by yourself or by your family members, friends, or anyone else as recommended by you. - In case you (client) want the refund - then a minimum 10% service charge would be applicable on the total cost of the tour package and the remaining amount (after deducting this 10% service charge) would be refunded.
  3. In both conditions mentioned above, the cancellation charges, as applicable for cancellation of services related to flight tickets, hotel bookings, guide services, and other travel services would also be recovered from the client.
  4. In case you cancel your tour after commencement, the refund of a limited amount would depend on the funds that we would be able to recover from the hotels, airlines, transporter, and other suppliers we patronize. For unused hotel accommodation, flight tickets, transportation, missed meals, and any other services, etc. India Awaits won’t be responsible for a refund from the service providers.
  5. A separate cancellation policy is applicable in case of special train journeys (like Palace on Wheels, Deccan Odyssey, Golden Chariot & Maharajas Express). It would advised to you as and when required.
  6. Please note that if you cancel the bookings during the below-mentioned period due to whatever reason, you (the client) will not get any refund. - Festival Period Bookings (Festivals like - Diwali, Dussehra, Holi, Pushkar fair etc). - High Peak Season bookings (from 20th Dec to 15th Jan). - Long Weekend Bookings.
  7. Please note that the cancellation amount is calculated as per the total booking amount and not as per the amount you paid in advance.

Refund:

In the case of unused services (which have been paid for and canceled in advance), we calculate the refund amount using the above-described cancellation policy. The refund amount calculated would be reimbursed to the person who made the payment to us. Due to banking requirements, the reimbursement process may take 2 to 4 weeks. If the refund is issued to either a credit card or a bank account, the bank fees will be deducted from the refunded amount.


Mandatory Identification Document:

All guests (Foreign Nationals, NRI’s, and Indian Nationals) must provide a Photo ID at the time of booking confirmation. Here are the documentation requirements applicable for different categories :

For foreign nationals – a copy of the Passport + Visa is mandatory.

For Non-Resident Indians clients (NRI clients) – a copy of passport.

For Overseas Indian clients holding OCI / PIO cards – a copy of their passport and a copy of OCI/PIO card are mandatory.

For domestic clients – a copy of a Driving License / Voter ID Card/passport is mandatory.


Arrival and Departure Policy:

Check-In Timings: 1200 - 1500 Hours

Early arrival will be subject to availability. You must enquire before your arrival. For guaranteed early check-in, you need to make a reservation starting from the previous night of the arrival date.

Check-Out Timings: 1000 - 1200 Hours

Late check-outs are available on request and subject to availability. For guaranteed late check-outs, you need to make reservations for the night.


Extra Usage of Vehicle:
We do not allow the extra usage of vehicles  (cars/coaches with the driver) after transferring to the hotel or after sightseeing as we do not charge for the extra usage.

Special Note for Helicopter Journeys:-
  1. Helicopter tickets and fares are subject to availability and may change at any moment.
  2. While we at India Awaits try our best to fly you by Helicopter with full safety, due to sudden weather conditions, VIP Movement, or unavoidable situations at the last moment - it sometimes becomes unavailable. In that case, we will make all possible attempts to get you on an alternate helicopter on the same or the next best time, depending on the availability. India Awaits will make every possible attempt to arrange for an alternate Helicopter journey on the same day or alternate dates depending upon the availability of the Helicopter at that time.
  3. India Awaits will not carry forward any ticket to the next day.
  4. India Awaits will not pay, reimburse, or compensate you with accommodation, meals, or cost of transport due to the cancellation of the Helicopter.

Our liabilities & limitations:

It is important to note that after we confirm the service cost of your tour if there are any hikes in the entrance fees of monuments/museums, taxes, fuel costs, or guide charges by the Indian government or other authorities, the same would be charged extra from you.


India Awaits rates are based on the general rates prevalent in the market and further negotiated by us with the hotels, airlines, etc. The concerned hotels and airlines may also modify their rates without prior notice. In such circumstances, - the travel cost quoted to you by India Awaits is subject to change as per the price modifications by hotels or airlines.


All exchange orders, receipts, contracts, coupons, and tickets issued by India Awaits are subject to the terms and conditions under which these services are provided by hotels, airlines, transporters, railways, and contractors. India Awaits and its associates act only in the capacity of an agent for these parties. The only contract between the clients and any contractors providing services will be the tickets, vouchers, or passage contract that the carrier, hotel, or other contractors provide.


We at India Awaits have created sample itineraries so that the clients can have a general outlook of the tour plan and schedule. Though these itineraries best resemble how our tour would look, the changes before the tour or on the trail may be subject to factors such as weather, route conditions, and the participant’s physical capacity. India Awaits reserves the right to make changes to various parts of the itinerary such as transportation, accommodation, or locations for the convenience, safety, comfort, and well-being of the participants of the trip. We can make the changes without prior notice and without making any rebate, allowance, or refund. The extra cost incurred after the change(if any), would be payable by the client.


India Awaits shall not be held responsible for the extra expenses, various losses, injuries, damages, and changes or delays in the program, due to weather conditions, natural calamities, accidents, flight delays or cancellations, breakdown of transport or machinery, fire, sickness, political closures, the act of god, act of government, wars, riots, civil upheavals, theft, pilferage, epidemics, quarantines, regulations by medical or custom departments, or any other causes beyond our control or any untoward incidents or any such causes whatsoever including any liability or extra expenses sustained by the Clients.


India Awaits shall not be held responsible and shall not accept any liability towards the client or their legal representatives for any loss of property, damages, death, injuries, or loss of services whether resulting from the act, negligence, or default by any transportation company, hotel agents, or service providers providing such services or facilities or arising out of or while engaged in any tour, means of transportation or other services, whether due to ownership, maintenance, use, operation or control of any automobile, bicycle, boat, motor, or other vehicles in the common carrier or otherwise and whether due to its or their negligence or otherwise or regardless of how caused.


Clients using bicycles, sailing boats, scuba diving gear, or any other sporting equipment hired or supplied by hotels or rental bodies shall do so at their own risk. India Awaits does not offer any insurance policy covering the expenses that arise due to accidents, sickness, loss due to theft, or other reasons. India Awaits advises that clients get insurance arrangements in their home country. Your property and belongings while you are here will be at your own risk.



India Awaits reserves the right to cancel any travel services in case the tour, trip, or passage seems impracticable based on practical reasons. In such cases, India Awaits offers a refund, and other than that, there can not be any further claims against us for any whatsoever reason. India Awaits also reserves the right to refuse to continue the contract with any person that deems (to us) undesirable at our absolute discretion and we are not compelled to deliver any reason for doing so.


Force Majeure:

India Awaits (we, the company) and any of its parent companies, subsidiaries, affiliates, officers, directors, other position holders, employees, agents, or suppliers and their respective successors, heirs, and permitted assigns shall not be held responsible for, or be deemed to be in default on account of any failure to perform or due to delay in performance of any of its commitments hereunder, in whole or in part if such performance is rendered impracticable in the events of acts of war, whether declared or undeclared, sabotage, acts of terrorism, riot or other civil commotion, failure in transportation, the act of any government or any court or administrative agency thereof, acts of God, fire, explosion, flood, earthquake, strike, the act of government or other catastrophes, pandemic, epidemics, an outbreak of disease or quarantine restrictions, or other cause(s) beyond the reasonable control of India Awaits (“Force Majeure”).


India Awaits (company) and client (you)– both shall use their best efforts to avoid, overcome, and offset the effects of any cause or potential cause of an event of Force Majeure. Upon cessation of the cause of the Force Majeure, the Terms and Conditions of use given hereunder shall again become fully operative.


However, a Force Majeure event will not relieve India Awaits (company) and client (you) of the obligations accrued before the occurrence of the Force Majeure.


Jurisdiction Clause:

All the disputes regarding this agreement or any other ensuing agreement would be subject to Jaipur Courts only.


Special Note:

Terms & Conditions for Andaman & Nicobar Island, Lakshadweep Island are different from the above discussed, and those terms will be informed as the case demands.

l Terms & conditions for booking in Groups will be different from the above discussed and same will be informed as the case demands.
